Guardianships and Conservatorships: When an individual becomes incapacitated and that individual is without a general durable power of attorney or health care power of attorney, the probate court can step in and appoint a guardian and/or conservator to assist the incapacitated individual. A guardian handles the health care decisions for the individual and the conservator handles the financial affairs of the individual.   The scope of the guardian’s and/or conservator’s authority, vary on a case by case basis. A conservator may also be appointed for a minor who receives assets of $10,000 or more.
